That Mannheim Labor Court rejected the dismissal protection suit on December 1, 2021, as a spokeswoman announced. The plaintiff violated an employment contract duty through his behavior. The fact that he manipulated data in a targeted manner over a longer period of time resulted in a definitive loss of trust on the part of the employer. A comparison had not come about in the run-up to a quality appointment.
The software company had accused Zeiger of having forged or deleted internal works council documents – possibly to cover a works council colleague. As the head of the works council, he was asked to help clarify a compliance procedure against a colleague from the works council – there is suspicion of wage fraud.
Zeiger’s lawyer had already stated on the occasion of the settlement appointment that his client had admitted interference with certain documents. But he also reversed this and apologized several times. Zeiger had received the termination without notice from SAP in the summer of 2021, whereupon he defended himself with a lawsuit. Even before he was kicked out, he had resigned from his position as head of the works council. From his post in SAP supervisory board he has since been dismissed by the court. (dpa / rw)
