Spot the Ball Competition Terms And Conditions

 

1. THE PROMOTER

Registered users of the competition services shall herein be referred to as “you”.

2. THE COMPETITION  

2.1 The title of the competition is Winabode.com.

2.2 The competition is a skill based prize competition whereby upon entering the competition and payment of the entry fee by credit card or direct debit, you will be asked to answer a skill based question.

2.3 Competitions are entered via the Website. One or more Competitions may be operated at the same time and each Competition will have specific prize options.

2.4 Availability and pricing of Competitions and tickets is at the discretion of the Promoter and will be specified on the Website. 

2.5 for each Competition you will need to complete a ‘Spot the Ball’ challenge onscreen, which shall operate as follows:

(i) you will be shown a photograph which will not contain a ball;

(ii) using all the information shown in the photograph displayed on the computer screen use your skill and judgement to correctly identify the grid square within which you consider the Judge will decide, is the most likely position for the ball if one had been present in the image;

(iii) click on the screen to mark this spot. The computer will register this spot as your entry into the Competition ('Spot the Ball Challenge');

(c) You may repeat the process for the ‘Spot the Ball Challenge' for as many entries as you wish to make, up to the specified limit. You will require tickets for each entry.

2.6 When playing a Competition on the Website via your laptop/tablet/phone, follow the on-screen instructions to:

(a) Select the prize you want to win and when you are ready purchase your Ticket(s), provide your contact and payment details. You will need to check your details carefully and tick the declaration, confirming you have read and understood the Competition terms and conditions;

(b) Once you have purchased your Ticket(s), play the ‘Spot the Wedding Ball Challenge' in accordance with 3.4(b) and (c);

(c) We will then contact you by email to confirm your entry into the Competition. Please note that you will not be deemed entered into the Competition until we confirm your order back to you by email.

2.7 The Promoter reserves the right to refuse or disqualify any incomplete Entries if it has reasonable grounds for believing that an Entrant has contravened any of these terms and conditions.

2.8 To the extent permitted by applicable law, all Entries become our property and will not be returned.

2.9 Competitions: Entries are limited to one hundred (100) per person, per Competition. Abuse of this limit will not be tolerated and if the Promoter has reasonable grounds to believe that an individual is exceeding this limit, for example by entering a Competition using multiple accounts, it reserves the right at its sole discretion to void any orders, any Ticket(s) or to award any prize to the next closest entrant.

3. HOW TO ENTER  

3.1 You may enter the competition at our website winabode.com, upon completing the required information and making payment with a form of payment accepted by the Promoter. 

3.2 There is a charge for each time you wish to enter the competition online, the amount of which will be set out on the website. Payment may be made by credit card, debit card or third party payment system to be made following the instructions of the competition website. 

3.3 By entering the prize competition online, you acknowledge that you agree to these competition terms and conditions.

3.4 The Promoter will not accept:

  1. (a) responsibility for competition entries that are lost, regardless of cause, including, for example, as a result of any equipment failure, loss of entry in the post, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or
  2. (b) proof of transmission as proof of receipt of entry to the competition.

4. COMPETITION JUDGEMENT

4.1 Spot the Ball Competitions: The position of the ball will be determined after the close of the Competition by a panel of Judges (professionals appointed by the Promoter – the 'Judge') using their experience and in the presence a representative from the Promoter ('Judge's Position').

4.2 Within 24 hours of the end of the respective Competition, the Judge's Position will be computed against the database of coordinates to mathematically calculate which of the valid and eligible Entries received by the Promoter is closest to the Judge's Position, and therefore the winning Entrant (the 'First Prize Winner') of the prize. The First Prize Winner will be the person who correctly identifies, or if no one is correct, who is closest to, the Judge's Position.

4.3  Spot the Ball Competitions: In the event that there are two or more Entrants with valid and eligible Entries that are equally close to or exactly match the Judge's Position (each a 'Tie Break Entry'), the entrants to whom such Tie Break Entries belong will be drawn out of a hat by a member of the judging panel at random to determine the First Prize Winner.

5. ELIGIBILITY  

5.1 The competition is only open to all residents in the UK aged 18 years or over, except: 

  1. (a) employees of the Promoter or its holding or subsidiary companies;
  2. (b) employees of agents or suppliers of the Promoter or its holding or subsidiary companies, who are professionally connected with the competition or its administration; or
  3. (c) members of the immediate families or households of (a) and (b) above.

Promoter will not award prizes to any person entering the competition who is not resident in the UK and assumes no liability therefore. Promoter specifically disclaims for any liability arising out of any person entering or participating in the competition in jurisdictions outside the UK where it is restricted or prohibited.

5.2 The Promoter will not accept competition entries that are:

6. THE PRIZE  

6.1 The prize for the competition will be a specific item, as described on the competition website, or cash prize if for any reason that item is no longer available. The amount of the cash prize shall be only for the then current cash raised by the competition up to the amount offered for the specific item less an administration fee of 25% plus VAT retained by Promoter. 

6.2  Promoter provides the grand prize winner with no liability therefore and the prize winner shall be solely responsible for conducting its own searches and due diligence on the item. The grand prize winner shall not be entitled to claim the cash equivalent upon being unsatisfied.

6.3 The funding for the grand prize will be derived from the entry fees received. Should the number of entrants not equal or exceed the grand prize value at the end of the completion term, the prize will be substituted with the amount of entry fees actually received, less a 25% plus VAT administrative charge to be retained by the Promoter. 

6.4 The competition will be operated for a 10-day period or once a sufficient number of tickets have been sold. Promoter reserves the right to extend the competition. Judging of the 'Spot the Ball Challenge' will take place within 14 days of the end of the competition period.  

6.5 Any tax liabilities arising from the award of the prizes or any other costs incurred by you in relation to participating in the competition or the award of any prize shall be the sole responsibility of the competition winner.
